Problem

Andreas was doing research at Philips. He applied for 4 patents while he was there. After spending way too much time talking to the IP team, he realized that they hold 50,000 patents with a team of ~10 people to defend them.

A little background: a patent costs around $50k to obtain and maintain. $17k is non-negotiable, paid directly in fees. That means their portfolio costs $850M to $2.5B. The best part is that they, and pretty much every company in the world, rely on Googling competitors and sending salespeople to trade shows to hear about new products that could be infringing. This whole portfolio is making little to no revenue.

Solution

Super simplified to keep it easy to understand:

βœ… They let companies upload their patents and get a list of claim charts showing what products are infringing and how, in 20 minutes instead of months.

βœ… When companies get sued, they can use them to find counter litigation, since the person suing them is most likely infringing on some of the patents they hold too.

βœ… The most common way to get these cases thrown out of court is by considering a patent invalid. That means there is some proof, like other patents, research papers, or products that existed before your patent was filed. They find all these and confirm your patents will hold up in court.

As you can imagine, pretty much everyone they work with has them under NDA. What they can tell you is that they work with private inventors up to Fortune and Global 500 companies.

But also, the US Patent Office is tightening the rules for challenging patents in its review court. The director is being pickier about which cases get heard, and some evidence no longer counts.
